Terms and conditions
The short version
- You tell us what you need. We quote a fixed price. Nothing starts until you approve it.
- You confirm you have the right to have the part reproduced. We're making it at your direction.
- We don't make parts whose failure could hurt someone. No exceptions, and we'll tell you early.
- What we make is not an OEM part and isn't tested to any OEM or regulatory standard. You decide whether it's right for the job.
- You own your files once you've paid. We keep a copy for a year unless you ask us not to.
This summary is here so you know what you're agreeing to without reading twelve pages. It isn't part of the agreement — the numbered sections below are what govern.
01 About these terms
These terms govern work performed by CyberForge Labs LLC, a Texas limited liability company ("CyberForge Labs," "we," "us"), for any customer ("you") who submits a request through this website, accepts a quote, or sends us a part.
You accept these terms when you submit a request through this site or approve a quote. The version in effect on the date you accepted is the version that applies to that work, and it's recorded with your submission. Later changes don't apply retroactively to work already agreed.
02 Definitions
- Part
- A physical object you send us, bring to us, or ask us to produce.
- Deliverable
- Anything we hand back: scan data, a mesh file, a CAD model, a printed part, or a written assessment.
- Quote
- The written scope and fixed price we send you for a specific job, including any stated assumptions and exclusions.
- Safety-critical
- Any component whose failure could disrupt a safety system, cause injury, or cause a loss of control of a vehicle, vessel, aircraft, machine or structure. Section 6 explains how we apply this.
03 What we do
We provide 3D scanning, CAD review and modeling, and additive manufacturing as services performed at your direction. You specify what you need and what it's for. We produce it to that specification.
We are a service provider, not a manufacturer of consumer goods. We do not design, certify, test, list, catalogue or sell parts as products. We do not hold ourselves out as the original manufacturer of any part we reproduce, and we are not affiliated with, endorsed by, or acting on behalf of any vehicle, vessel, equipment or component manufacturer whose parts you may ask us to work on.
04 Quotes, approval and changes
Quotes are fixed-price and valid for 30 days. Hours are how we build an estimate, not how we bill you — you pay the number on the approved quote.
Quotes are based on the information and photographs you provide. If the part turns out to differ materially from what we were shown, or requires work outside the quoted scope, we will stop and come back to you with a revised quote before continuing. We won't add charges to an invoice you've already approved.
No work begins until you approve a quote in writing. We may decline any request, at any time, for any reason, including after a quote has been issued. If we decline after you've paid, we refund in full less work already performed at your direction.
Turnaround times we give you are estimates based on current workload, not guarantees, and they run from the day the part is physically in our hands.
05 Intellectual property in your part
By submitting a request or sending us a part, you represent and warrant that you have the legal right to have that part scanned, modeled and reproduced, and that doing so will not infringe any patent, copyright, trademark, trade dress or other right of a third party.
You are in a far better position than we are to know where a part came from and what rights attach to it. We rely on your representation and do not independently investigate the provenance or IP status of parts submitted to us.
What we decline on sight
We will not reproduce logos, badges, emblems, brand names or other trademarked identifying elements, and we'll remove or omit them from any part we produce. We'll also decline work where it's reasonably apparent that reproduction would infringe someone's rights — including production runs of parts that are still commercially available from the original manufacturer.
A one-off for your own vehicle is not the same as a production run for resale. We treat them differently, and you should tell us which one you're asking for. Parts intended for resale or distribution require a separate conversation before we quote.
06 Work we don't take on
This is the section we're least flexible about.
We do not reproduce, modify or produce any part whose failure could disrupt a safety system, cause injury, or cause a loss of control.
That standard is written broadly on purpose. A list of forbidden parts always has gaps; a standard covers the case nobody thought to list. What matters is not what a part is called, but what happens when it fails — whether anything moves, stops or steers differently, where the pieces go, and who is standing near them.
How that applies in practice
The following are examples of the standard, not the limits of it. We decline work involving:
- Braking, steering, suspension and throttle components
- Fuel, oil, coolant and pressurized systems
- Restraint systems, and any trim or panel located in an airbag deployment path
- Anything carrying structural load, or retaining a wheel, seat or occupant
- Anything inside an engine intake tract, where a failed part is drawn into the engine
- Marine steering and control linkages, through-hull fittings and anything below the waterline
- Any aircraft or aviation component, certified or otherwise
- Firearm components, and parts designed to defeat emissions or safety equipment
- Lifting, rigging, fall-arrest, medical, and life-safety equipment of any kind
Some parts that look purely cosmetic fall under this standard. Interior trim sitting over an airbag is engineered to break a specific way in roughly thirty milliseconds; a printed replacement is not, and becomes debris. Interior materials are also subject to flammability standards that printed filament is not tested against.
If you're not certain which side of the line your part falls on, ask before you ship it. Our declining a request is not a judgment about you, and we'd rather have the conversation early than return a part untouched.
Our accepting a job is not a determination that the part is safe. It means the request didn't present an apparent safety concern based on what you told us. Section 8 covers who decides suitability.
07 No OEM equivalence
Any part we produce:
- Is not an original equipment manufacturer (OEM) component
- Is not manufactured using OEM materials, processes or tolerances
- Has not been tested or certified to any OEM, industry or regulatory standard
- Is not warranted to perform equivalently to the part it replaces
We make no representation that a reproduced part is as strong as, as durable as, or interchangeable with an original. Where we modify a design at your request, we make no representation that the modification improves the part in any respect.
08 Suitability and intended use
You determine whether a deliverable is suitable for its intended use. You know the application, the loads, the environment and the consequences of failure. We do not, beyond what you tell us.
You agree to tell us what the part is for at the time of your request, and to tell us if that changes. Where we produce a part for a use you described, that use is recorded with the job. Using a part for something materially different from what you described is outside the scope of what we agreed to.
Where a deliverable's performance matters, you are responsible for testing and inspecting it before putting it into service.
09 Limits of the process
We'd rather you know these going in than discover them later. 3D scanning and additive manufacturing have real constraints:
- Scanning captures surfaces. It cannot see inside a closed cavity, and it will not recreate a feature that has already broken off.
- Scan accuracy is high but is not machine-shop metrology. We'll tell you the tolerance you can expect for your part.
- Printed parts are strongest along the print layers and weakest across them. Strength depends on orientation, wall count and infill as much as on material.
- Printed materials degrade with heat, UV exposure, chemicals, moisture and repeated loading, at rates that vary by material and environment.
- Color, surface finish and texture are approximations, not matches.
Our materials guide covers what each material survives and where each one fails.
10 Your part in our care
We take reasonable care of parts you send us and return them in the condition they arrived in. Some processes require temporary surface preparation — a removable scanning spray or reference markers — which we remove before returning the part. If a part is fragile or irreplaceable, tell us before you ship.
You are responsible for packaging and for shipping costs in both directions unless the quote says otherwise. Risk of loss in transit sits with the sender. Insure anything you'd be upset to lose.
Parts left unclaimed more than 90 days after we notify you that work is complete, or after we decline a request, may be disposed of.
11 Files, data and ownership
On payment in full, you own the deliverables produced for you and may use, modify and reproduce them for your own purposes without further permission from us.
We retain a working copy of scan data and files for 12 months so we can re-cut, revise or reprint without rescanning your part. After that we may delete them. Tell us at any time and we'll delete your files sooner, though that means a rescan if you come back.
We do not sell, license or share your files with anyone, and we do not reproduce your part for anyone else.
Showing our work
We may photograph parts we work on and show them in our portfolio and on social media. If you'd rather we didn't, say so — before, during or after the job — and we won't. We never publish customer names, drawings or files without written permission.
We retain ownership of our own methods, tooling, process knowledge and any general-purpose techniques developed in the course of the work.
12 Payment
Payment terms are stated on your quote. We may require a deposit before work begins, particularly on larger jobs or first engagements. Final payment is due before deliverables are released or a part is shipped back.
If you cancel after approving a quote, you're responsible for work already performed, calculated at our published hourly rate, and any deposit is applied against it. We'll tell you where the job stands before you decide.
Prices exclude shipping and applicable Texas sales tax.
13 Warranty
We warrant that we'll perform our work with the reasonable skill and care of a competent provider in this field, and that deliverables will match the scope described in your approved quote. If we get something wrong on our end — a scan that doesn't match the part, a print with a defect we should have caught — tell us within 14 days of receipt and we'll correct it or refund that portion of the work.
Beyond that, deliverables are provided as is. To the fullest extent permitted by Texas law, we disclaim all other warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, and non-infringement. No advice or information we give you, written or verbal, creates a warranty not stated here.
14 Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or relating to any job — whether in contract, tort, negligence, strict liability or otherwise — is limited to the amount you paid us for that job.
We are not liable for indirect, incidental, consequential, special or punitive damages, or for lost profits, lost data, loss of use, damage to a vehicle, vessel or equipment, or the cost of substitute goods or services, even if we were told such damages were possible.
Nothing in these terms limits liability that cannot be limited under Texas law, including liability for fraud, or for death or personal injury caused by our negligence.
15 Indemnification
You agree to defend, indemnify and hold harmless CyberForge Labs LLC and its members, employees and contractors from any third-party claim, demand, loss, damage, liability, cost or expense (including reasonable legal fees) arising out of or relating to:
- Your use, installation, sale or distribution of any deliverable
- Any breach of your representations in section 5, including claims that a part we produced at your direction infringes someone's rights
- Any use of a deliverable materially different from the intended use you described to us
- Any inaccurate or incomplete information you gave us about a part or its application
16 Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Travis County, Texas, and both parties consent to that jurisdiction.
If any provision of these terms is held unenforceable, the rest remains in force and the unenforceable provision is modified to the minimum extent necessary to make it enforceable. Together with your approved quote, these terms are the entire agreement between us on this subject.
17 Changes to these terms
We may update these terms. Each version carries a version number and effective date, and previous versions are archived. The version you accepted at the time of your submission or quote approval is the one that governs that work — we don't apply changes retroactively.
Continuing to use the site or submitting a new request after a change means you accept the version in effect at that time.
18 Contact
Questions about these terms, or about whether we can take on a particular part, go to sales@cyberforgelabs.ai. We reply within one business day.
How we handle the information you send us is covered separately in our privacy policy.
Not sure whether we can take on your part?
Send a photo and tell us what it does. If it's outside what we take on, we'll tell you straight away and point you somewhere better — no quote, no back and forth, no shipping something across the country for nothing.
